1. Detailed Description of Goods and/or Services
EIS is a retail business in the Engineering industry that sells fasteners, abrasives, cutting tools, hand tools, lathe tools, paints, brushware, fittings, welding, hardware, electrical, oil & adhesives.
2. Delivery Policy
Subject to availability and receipt of payment, your order will be delivered by courier within 2-5 working days.
Local EIS Delivery
EIS offers free delivery using our local delivery fleet for orders over the value of R50 including VAT in major industrial areas around Durban. Please contact us with your address for clarity whether or not you fall into one of these areas. Should your order be less than R50, normal economy road freight will be charged.

EIS will make every reasonable endeavour to ensure timeous delivery of the goods on the terms and conditions agreed between the customer and EIS however EIS shall not be liable for late deliveries due to circumstances which are beyond EIS’s control. Signature by the customer or by any representative of the customer on EIS’s delivery note shall be regarded as acceptance by the customer that the goods reflected in such delivery note have been properly and completely delivered. Our courier service shall require a signature from the person taking collection of the item at your delivery address. This signature will amount to confirmation that the delivery has taken place. We will e-mail you with a tracking number as soon as the order has been processed. EIS will not be liable for an incorrect delivery where you have made an error and provided an incorrect delivery address.
3. FREE Delivery for orders over R1150.00
For orders over R1150.00 (VAT inclusive) placed in South Africa only, your shipping will be covered by EIS up to a combined weight of 25kg (The greater of volumetric and physical weight). Free delivery does NOT apply to outlying areas due to a very large variance in outlying freight costs. Order that does not meet the above criteria shall be charged for delivery accordingly.
4. Payment Options Accepted
Payment may be made via Visa, MasterCard, Diners or American Express Credit Cards, as well as via SiD Secure EFT.
5. Card Acquiring and Security
Card transactions will be acquired for EIS via PayFast (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayFast uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
6. Ownership of Goods
Until such time as the customer has paid the purchase price in full in respect of any purchase of goods, the ownership of all such goods shall remain with EIS. Subject to any applicable law, EIS shall in its sole discretion and without notice to the customer be entitled to take possession of any such goods which have not been paid for and in respect of which payment is overdue in which event the customer shall be entitled to a credit in respect of the goods so returned being the price at which the goods are sold or the value thereof as determined by EIS.

The offering on this website is available to South African clients only.
8. Return and Refunds Policy
The provision of goods and services by EIS is subject to availability. In cases of unavailability, EIS will refund the client in full within 30 days. Cancellation of orders by the client will attract a 10% administration fee. Subject to any applicable law, all goods purchased shall be regarded as having been sold as is without warranty against latent defects. Please enquire with our sales team regarding guarantees. No liability shall arise on the part of EIS for any representation or warranty made or alleged to have been made in respect of goods sold by EIS to the customer. EIS’s liability in respect of any claim based on defective goods shall be limited to repairing or replacing such defective goods, at the discretion of EIS, during any applicable warranty period, provided that such defective goods are returned to EIS in their original state and packaging and at the customer’s cost within the applicable warranty period. In circumstances where the goods are not manufactured by EIS, EIS’s liability shall in no circumstances extended beyond any corresponding liability of the manufacturer or supplier of such goods to EIS. In circumstances where the Purchaser wishes to return non-defective goods to the Company for credit, the Company may, in its sole and absolute discretion (subject to applicable law), agree to the return of such goods subject to the goods being new, unused, in their original packaging and in a saleable condition. The Purchaser shall be obliged to furnish adequate written proof of having purchased the goods from the Company. The Purchaser will be liable for returning the unwanted goods to EIS. Subject to applicable law, the Company shall be entitled to a minimum 10% handling fee for any goods which are returned for credit. Notwithstanding the prevailing price of the goods at the time that they are returned to EIS, the price reflected on the customer’s proof of purchase shall be the price credited by EIS to the customer for the return of the goods, less the handling fee.
9. Customer Privacy Policy
EIS shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). 10. Customer Details Separate from Card Details
Customer details will be stored by EIS separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za.
11. Merchant Outlet Country and Transaction Currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
12. Responsibility
EIS takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
13. Indemnities
Subject to any applicable law, the customer acknowledges that it will indemnify and hold EIS harmless against any liability in respect of the goods, including under the Occupational Health and Safety Act 85 of 1993 and the Mine Health and Safety Act 29 of 1996. Subject to any applicable law, specific reference to sections 10 and 21 of the respective legislation as it applies to product liability is disclaimed by EIS. The customer shall be obliged to and warrants that it will ensure that a qualified technician and/or electrician installs all goods purchased from EIS which require installation by such qualified persons. Should the customer fail to comply with such obligation, the customer indemnifies EIS from any liability arising from the purchase of the goods. The customer acknowledges that it does not rely in any manner on any representations and/or advice of EIS in its decision to purchase particular goods from EIS.
14. Costs
All costs incurred in any action against the customer, including costs on an attorney and own client scale and attorney’s collection commissions, will be paid by the customer should EIS be successful in such action or proceeding. The customer will reimburse EIS for all costs incurred in recovering any amount owing by the customer to EIS, including but not limited to its legal costs incurred in proceeding against the customer, howsoever those costs are incurred and whether they are incurred prior to the institution of action, after the entry of judgment or at any other time.
15. Proof of Amount Due, Owing and Unpaid to the Company
A certificate signed by the company secretary, any manager or any director of EIS reflecting the amount owing by the customer to EIS in relation to the customer’s dealings with EIS and the fact that such amount is due, owing and unpaid shall be prima facie (on the face of it) proof of such facts for the purpose of any action (whether by way of Provisional Sentence or otherwise), proof of debt on insolvency or for any purpose where the amount of such claim is required to be established and it shall rest entirely with the customer to prove that such amount is not owing, due and/or unpaid.
16. Entire Agreement
These terms and conditions are in addition to and not in substitution for any signed trading terms and conditions entered into between the customer and EIS. The customer acknowledges that no terms at variance with these terms which have been sought to be introduced by the customer at any time shall be of any force or effect unless EIS has, in writing, expressly and unambiguously agreed that the terms so sought to be introduced by the customer shall apply. Without limiting this, EIS shall not be regarded as having so expressly agreed to such terms by virtue of EIS having agreed to execute an order in which inconsistent terms have been introduced by the customer and despite the fact that EIS has not rejected such inconsistent terms.
17. Non-Waiver
Any condonation of any breach of any of these terms and conditions or other act or relaxation, indulgence or grace on the part of EIS shall not operate as or be deemed to be a waiver by EIS of any of its rights or be construed as a novation of the agreement between the customer and EIS.
18. Severability
These terms and conditions, despite the manner in which they have been grouped together or linked grammatically, are severable from each other. Any term or condition which is or becomes unenforceable in any jurisdiction in which it applies or in which its enforcement is sought, whether due to voidness, invalidity, illegality, unlawfulness or for any other reason whatever, shall, only to the extent that it is so unenforceable, be treated as pro non scripto (as if it had not been written) and the remaining terms and conditions shall remain of full force and effect
19. Disclaimer
EIS has the right to cancel any orders due to errors by website administrators, especially with regards to price errors and images.
20. Country of Domicile
This website is governed by the laws of South Africa and EIS chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, PO Box 12652, Jacobs, 4026, Durban, South Africa.
21. Variation
EIS may, in its sole discretion, change this agreement or any part thereof at any time without notice.
